Pauhu® Ltd's rights in the database, and the licence under which the European data foundation is offered through the dataspace connector.
Our rights in this database
Pauhu Ltd builds and maintains a curated database of European reference material. It is sourced from published authorities, aligned across languages, annotated with stable concept identifiers, and kept current by a continuous pipeline.
The contents of the source materials, for example EUR-Lex and IATE, remain the property of their respective publishers. We do not claim rights in those source facts. We claim rights in our substantial investment in obtaining, verifying and presenting the database, and in its original selection and arrangement.
Sui generis database right
Our substantial investment in obtaining, verifying and presenting the contents of this database is protected by the sui generis database right under Directive 96/9/EC, Article 7 (EUR-Lex). This right is independent of any copyright in the contents and allows us to prevent the extraction or re-utilisation of the whole or of a substantial part of the database.
The term of protection is fifteen years (Article 10(1)). A substantial new investment, including one resulting from the accumulation of successive additions, deletions and updates, qualifies the resulting database for its own fresh term (Article 10(3)). This database is updated continuously.
Copyright
The original selection and arrangement of the database is protected by copyright under Directive 96/9/EC, Article 3 (EUR-Lex). Copyright in the database structure is separate from any rights in the underlying source contents.
Trade mark
Pauhu is a trade mark of Pauhu Ltd.
Licence
How the database is offered, and on what terms.
How this data is offered
This database is made available under licence, agreed and enforced through the dataspace connector. Access and use require an active agreement. The machine-readable terms of use are asserted at the connector as an outbound policy.
Text and data mining is expressly reserved
The rightholder expressly reserves the use of this database for text and data mining, in machine-readable form, under Directive (EU) 2019/790, Article 4(3) (EUR-Lex). The general text and data mining exception in Article 4 therefore does not apply to this database. Text and data mining of this database, including for the development or training of AI systems, requires a separate licence agreed through the connector.
The mandatory exception for scientific research by research organisations and cultural heritage institutions under Article 3 is unaffected, as the Directive requires.
Permitted use
Licensed use is governed by the agreement reached through the connector. In general, and subject to that agreement: results may be used and shown with their citation to the source; substantial parts of the database may not be extracted or re-utilised, and insubstantial parts may not be extracted or re-utilised repeatedly and systematically, without a licence.
Code
The Pauhu software is licensed separately under the GNU Affero General Public License (AGPL). The data licence above grants no rights in the source code, and the code licence grants no rights in the data.
